That's what grey foxes are known for, they give birth to their kits in trees too I think. Other foxes can climb trees to catch birds or search for nest.

They probably don't fall out of the tree as birds don't fall out of their nest. The foxes borrow in the tree and I assume a bit down into the tree so the kits would have to climb up a slope to get out of the tree cavity; which would make it difficult for a small kit to do.
